1 Acceptance of Terms

By accessing and using the Ortio mobile application (the "Service") on Android, developed by Prasad Mahankal, you agree to be bound by these Terms of Service. If you do not agree to these Terms, please do not use our Service.

2 Service Description

Ortio provides multilingual language exam preparation materials, including:

• Practice questions and quizzes for languages such as German, French, Spanish, Chinese, Japanese, and others.
• AI-powered Chat tutoring and speaking exercises using Google's Gemini 2.5 Flash Lite and Groq Whisper API.
• Human chat with end-to-end encryption (E2EE) using TweetNaCl.
• Community feeds, notes, and language games.

3 User Accounts

To access the features of Ortio, you must create a user account via email or Google Sign-In. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Age Requirement: You must be at least 13 years old (or the minimum age required in your jurisdiction) to create and use an Ortio account. If you are under the age of majority in your jurisdiction, you may only use the Service with the involvement of a parent or legal guardian where required by law.

You agree to provide accurate, current, and complete information during the registration process. You can permanently delete your account and all associated data directly from the in-app settings (Settings → Danger Zone → Delete Account) or by using our online Account Deletion Request Form.

4 Fees and Payments

4.1 Subscriptions and Tiers

Ortio offers paid premium features through a credit-based subscription system. This provides enhanced access to AI tutoring, advanced mock tests, and extended practice queries.

4.2 Payments and Billing

All in-app purchases and subscriptions are securely processed by Google Play Billing. Ortio never requests, receives, or stores your financial or credit card information.

4.3 Automatic Renewal & Cancellation

To ensure uninterrupted study, premium subscription plans renew automatically at the end of the billing cycle. You may cancel your subscription at any time through your Google Play Store settings. You will retain premium access until the end of your current paid billing period.

4.4 Subscription Changes

Subscription pricing, benefits, and features may change from time to time. Any such changes will not affect your current billing period and will be communicated in advance where required by applicable law.

4.5 Refunds

All subscriptions are managed via Google Play, and any requests for refunds must be processed in accordance with Google Play's standard refund policies. Exceptional circumstances can be directed to support.ortio@gmail.com.

5 Acceptable Use

You agree to use Ortio only for lawful purposes. You agree not to:

• Violate any applicable local, national, or international laws or regulations.
• Share your account credentials with others or use the service to commit fraud.
• Use the Service to transmit abusive, hateful, or harmful content to other users in the Human Chat or Community Feed.
• Attempt to reverse engineer, hack, or compromise the app or its servers.
• Use automated scraping systems or bots to extract our proprietary content or questions.

Users are solely responsible for any content they post, transmit, or share through Community Feed, Human Chat, comments, or other interactive features of the app.

We reserve the right, but not the obligation, to remove, restrict, review, or moderate any content that violates these Terms, applicable law, or the safety of other users.

Accounts found violating these rules may be suspended or permanently banned without prior notice.

6 Intellectual Property & Content Disclaimers

The Ortio application, including its underlying software, design, user interface, and original content (explanations, mock formats, AI configurations) is owned entirely by Prasad Mahankal and is protected by international copyright laws.

You are granted a personal, non-commercial, non-exclusive license to use the app for individual learning. You may not copy, extract, or redistribute the content for commercial purposes.

7 Privacy and Data Protection

We collect and process your personal data strictly in accordance with our Privacy Policy.

Your encrypted messages, practice data, and AI interactions are stored securely. By continuing to use the service, you confirm that you have read and consent to the data practices outlined in our Privacy Policy.

8 Third-Party Services Integration

Ortio relies on specialized third-party services to provide core functionality:

• AI Chat: Powered by Google Gemini 2.5 Flash Lite.
• Speech Recognition: Powered by Groq Whisper API.
• Database & Auth: Managed securely by Supabase.
• Infrastructure & Analytics: Provided by Google Firebase / Crashlytics.
• Advertising: Advertisements may be served through Google AdMob. Depending on your location and consent preferences, personalized or non-personalized ads may be displayed. You can manage your ad consent preferences via the in-app privacy settings.

You acknowledge that the usage of these features may transmit text and audio data to these providers solely for functionality fulfillment.

9 Limitation of Liability

The Service is provided on an "as is" and "as available" basis. While we strive for accuracy, we make no warranties perfectly matching the actual official exams or assuring successful examination results.

We do not guarantee that the Service will be uninterrupted, secure, error-free, or available at all times. Features may be modified, suspended, or discontinued without notice.

Success in any official language examination depends entirely on your personal preparation and skills. Ortio is not responsible for any examination failures, missed opportunities, or damages resulting from reliance on the practice materials provided in the app.

To the maximum extent permitted by law, Prasad Mahankal shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use, or inability to use, the Service.

10 Indemnification

You agree to defend, indemnify, and hold harmless Prasad Mahankal from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from your misuse of the Service or your violation of any of these Terms.

11 Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for conduct that violates these Terms of Service or is harmful to other users or the application itself.

12 Changes to Terms

We reserve the right to modify or replace these Terms at any time. When substantial updates occur, we will update the "Last Updated" date at the top of the terms and may notify users in the app. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

13 Governing Law

These Terms shall be interpreted and governed by the laws of India, without regard to conflict of law provisions. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra, India.
